State Hospital Finds Hoggle Not Competent to Stand Trial

That psychiatric evaluation on the Clarksburg mom who has been charged in connection with her children’s disappearance, was submitted on Monday, Felsen said.

In the filing made on Tuesday, Felsen says Hoggle’s mental state has deteriorated since she was visited by Montgomery County Police at Perkins on Oct. 1 so much so that it has required “emergency medication” to treat her. Felsen also says Hoggle had stopped eating. The court filing requests a court order for all subpoenaed information from the Montgomery County Police, for two police detectives to appear for a deposition and for charges against Hoggle to be dismissed. Hoggle is charged with neglect, abduction and hindering a police investigation. Felsen alleges police met with Hoggle on more than one occasion despite being told she was represented by an attorney and before a competency report was completed on her mental state.

Felsen would not comment to MyMCMedia Wednesday on the Perkins’ competency finding he revealed in his court filing.

“I don’t think it’s right to comment at this time,” he said.

Ramon Korionoff, spokesman for the Montgomery County State’s Attorney’s Office said “there was nothing new on Catherine Hoggle at this point.”

But, the family of the two missing kids, Jacob 2 and Sarah who turns 4 on Thursday tell MyMCMedia the competency report does not make a difference to their search to bring the children home. State’s Attorney John McCarthy had filed a request with the court that Hoggle be temporarily remanded to the police so she could show police where she left the children in early September. That request was denied by Judge Eugene Wolfe on Nov. 6. McCarthy had promised to refile that request if the hospital report showed Hoggle to be competent.

Catherine Hoggle’s mother, Lindsey Hoggle told MyMCMedia Wednesday she isn’t depending on her daughter to tell her where her grandchildren can be found.

“At this point we are realize we can’t depend on the fact that she is going to take us there,” Lindsey Hoggle said. This weekend the family continues what has been an every weekend, if not daily, vigil of searches and flier distributions to look for the kids. Searches are planned again this weekend, she said..

“It’s been a rough week,” Lindsey Hoggle said.

Since the children were last seen with their mother in early September, Catherine Hoggle; Troy Turner, the father of the missing children; Catherine Hoggle and Turner’s older son and now Sarah have had birthdays.

Turner said Thursday won’t be easy.

“It’s her birthday. I’ll spend it like I spent mine, looking for my kids. I’m going to find my kids,” Turner told MyMCMedia Wednesday.

Lindsey Hoggle said she believes perhaps the ruling on incompetency might help to get her daughter on a medication plan to help stabilize her mental state. Family have said Catherine Hoggle is a diagnosed schizophrenic. She’s been treated  through  in-patient and outpatient facilities for her mental condition, according to family.
