Hoggle Still Being Evaluated for Mental Competency (PHOTOS & VIDEO)
Montgomery County District Court Judge Eugene Wolfe denied State’s Attorney John McCarthy’s request to temporarily release Catherine Hoggle to the police Thursday because she had told the family she would lead them to the children.

Wolfe denied that request since Hoggle’s competency report has not yet been completed. She is undergoing a mental evaluation at the Clifton T. Perkins Hospital Center.
The Clarksburg mom was arrested September 12 and faces three misdemeanor charges- detaining a child, neglect of a minor and obstructing and hindering. Family have described Hoggle as being a paranoid schizophrenic. Her two children, Jacob, 2 and Sarah, 3 are still missing. She is being held without bond an awaiting mental evaluation.
Wolfe also refused to rule on Hoggle’s attorney, David Felsen’s request to dismiss the charges in the case. Felsen had filed the motion based on allegations that the Montgomery County Police inappropriately questioned Hoggle while she has been at the Clifton T. Perkins Hospital Center on Oct. 1.
Hoggle appeared in court in shackles and handcuffs. She never looked toward her family sitting behind her to her left.
Wolfe asked her questions about her charges. She responded saying she does understand some of them.
When Wolfe asked Hoggle how she was doing she replied, “I’ve been better.” She also told the judge her medications “knock me out.” She named three medications she is currently taking.
McCarthy told the judge he believed there was a difference between competency to stand trial and competency to show police where she allegedly left her children. Sheriff Darren Popkin was present in the courtroom presumably on standby in case Wolfe granted the motion to allow the police to have custody of Hoggle temporarily.
“Do I think that is will necessarily bear fruit, I don’t know but we are duty-bound to find out,” McCarthy told the judge in making the request.
Wolfe however, ruled with her competency in question, the request must be denied.
“This court is not convinced that this lady is currently competent,” Wolfe said, also ordering the police to have no additional contact with Hoggle.
After the ruling, Hoggle’s mother Lindsey Hoggle sobbed surrounded by family. She said she had hoped the court would have allowed Hoggle to lead them to her grandchildren.
McCarthy said after the hearing he expects to indict Hoggle on additional charges.
