Officer Fatally Shoots Man Inside Bank in Silver Spring

UPDATED, 5:15 p.m., July 23- Police released new details in the officer-involved fatal shooing of a Silver Spring man inside a bank July 22.

Police said Montgomery County Police Officer Michael Damskey fired one shot that struck  54-year-old Donovan Bayton in the torso killing him.

According to the latest news release, Damskey fired his gun after the “officers’ initial attempts to de-escalate the situation were unsuccessful.”

UPDATED, 2 p.m., July 23-The two officers who were involved in a fatal shooting of a man inside a Capital One Bank July 22 had less then three years of service at the department between the two of them.

The officers are Michael Damskey with less than one year of service with the department and Marcus Lee with less than two years of service with the department, according to a police press release.

In the news release Wednesday, police said Donovan Bayton, 54, from Silver Spring  failed to respond to officers’ instructions and displayed a knife which “threatened the safety of bank employees, citizens within the bank and the officers.”  That’s when one of the officers fired the shot that killed him.

As is standard procedure, police said Damskey and Lee  have been placed on paid administrative leave during the course of the investigation.

Detectives from the Montgomery County Police Major Crimes Division are investigating a fatal officer-involved shooting that occurred shortly before noon on July 22 inside the Capital One Bank at 8740 Arliss Street in Silver Spring.

According to a police account, 3rd District police officers responded to a trespassing call at the bank and inside the bank they encountered an adult male who was behaving “erratically.”

Police said the suspect failed to respond to officers’ instructions, displayed a knife and threatened the safety of the officers. Police said the suspect was shot by a Montgomery County police officer.

During the investigation, police said two knives were recovered at the scene.

Police have identified the suspect as Donovan Bayton, age 54, from Silver Spring. According to police, Bayton, who was struck in the torso, was transported to an area hospital where he died from his injuries.

As is standard procedure, police said the two involved 3rd District officers have been placed on paid administrative leave during the course of this investigation. Their identities are expected be released on July 23.

The investigation surrounding the circumstances of this incident is continuing.
